The New Eyeglass Rule Explained

What is the New Eyeglass Rule?

In June 2024, the Federal Trade Commission (FTC) announced the updates to the Eyeglass Rule, officially known as the “Ophthalmic Practice Rules”.

The new changes are designed to enhance consumer rights by ensuring patients automatically receive a copy of their eyeglass prescription after every eye exam. These changes officially take place in September 2024.

The key provisions of the new Eyeglass Rule include:

  1. Automatic Prescription Release: All eyecare providers are required to provide patients with a copy of their eyeglass prescription immediately after an eye exam, without the need to request it.
  2. Documentation of Prescription Release: Providers must document the release of the prescription, either by obtaining the patient’s signature on a confirmation form or by making a note in the patient’s file.
  3. Clarification of Dispensers’ Roles: The rule clarifies that eyewear dispensers are not required to verify the prescription with the eye care provider unless the patient specifically asks for verification.

Why is the New Eyeglass Rule Important?

The updated Eyeglass Rule is a critical step in protecting consumer rights. It fosters transparency and promotes competition within the eyewear market. By mandating the automatic release of prescriptions, consumers now are empowered to:

  • Shop Around: With their prescriptions in hand, patients can compare prices and services, potentially saving money and finding the best fit for their needs.
  • Avoid Unnecessary Purchases: Patients can avoid being pressured into buying eyewear directly from their provider, offering them more freedom and flexibility in their purchasing decisions.
  • Ensure Accurate Vision Correction: Access to their prescriptions allows consumers to verify the accuracy of their eyewear and seek second opinions if necessary.

Implications for Optometry Practices

  1. Increased Administrative Responsibilities: Practices must implement systems to ensure prescriptions are provided automatically and that the release is properly documented.
  2. Potential Revenue Impact: With more patients shopping around for eyewear, practices may face increased competition from online and discount retailers. This exacerbates the need for practices to provide differentiating services and emphasize quality and personalized care.
  3. Enhanced Compliance Requirements: Practices must ensure they comply with the documentation and release requirements to avoid potential fines or legal issues.

New FTC Eyeglass Rule: How Eye Cloud Pro is Responding

In response, Eye Cloud Pro is working on developing an integrated electronic signature capability. This capability will allow practices to have patients digitally sign for the prescription and automatically store documents directly within the system. This approach not only simplifies the process of providing prescriptions but also ensures that all records are securely stored and easily accessible, meeting the new compliance requirements.
